The Karnataka state government on 11 June 2013 amended the Karnataka
Police Act, 1963, to restore final powers over police transfers with the
government. Earlier, it was vested with the Police Establishment Board
(PEB). As per the latest amendment, the government will nominate members
to the PEB. Earlier, three officers not below ADGP rank would
automatically qualify to be on the PEB alongside the state police chief.
The amendment takes away the PEB's powers to recommend transfers
above Additional SP and gives power to government to modify the PEB
decision. It prescribes a minimum tenure of a year only for officers in
operational duties. However, it does not apply to officers heading
police stations or divisions.
PEB was set up following an SC order to reduce political
interference. In the last six months, the police department was facing
controversies with officers competing for top posts. Many officers
approached courts against transfers by the PEB.
